Shade On You Terms and Conditions

1. Agreement and scope
These Terms and Conditions govern use of the Shade On You iOS application (the App). By selecting Accept, you agree to these Terms. If you do not agree, you cannot use the App.
Shade On You provides journey-planning information about sunlight and shade on Hong Kong bus, green minibus and tram routes. It is an independent application and is not operated, authorised, sponsored, or endorsed by the Government of the Hong Kong Special Administrative Region, any transport operator, Apple, or any other data provider identified in the App.
2. Informational service
Shade On You recommendations are estimates for general information. They are not transport-operation instructions, safety advice, medical advice, or a guarantee of conditions inside a particular vehicle.
Actual conditions can differ because of vehicle design, window treatment, passenger position, temporary structures, traffic, route diversions, weather, data age, GPS accuracy, and other circumstances. You remain responsible for your journey decisions, personal comfort, and safety, and should follow all instructions from transport operators and public authorities.
3. Calculation limitations
Shade On You models the vehicle using a representative observation point at the selected deck's approximate height and produces a side recommendation, not an individual-seat prediction. Green minibuses use the lower profile. Results can use route geometry, journey timing, solar position, weather context, and installed building, terrain, tunnel, and covered-road data.
When detailed visibility data is unavailable, the App may offer a calculation that explicitly states: “No buildings or terrain information was used for this calculation.” Such a result can be materially less accurate, particularly near buildings, terrain, tunnels, covered roads, and termini.
Forecasts, live arrival estimates, route information, and downloadable packs may be delayed, incomplete, unavailable, changed, or withdrawn. Shade On You does not guarantee that any route, estimate, recommendation, or external service will be accurate, complete, current, or continuously available.
4. Data sources and attribution
Shade On You uses information supplied by third parties, including Hong Kong public transport and weather providers, DATA.GOV.HK, the Common Spatial Data Infrastructure Portal, and the Lands Department. Source acknowledgements, licences, and links are available under Settings → Attribution & Licences.
Government and relevant organisations retain their intellectual-property rights in their source data. Shade On You calculations and presentation are produced by Shade On You and must not be interpreted as statements or endorsements by those providers.
5. Location and information stored on the device
Nearby discovery and active-journey tracking require location permission. Location access is optional, but the related features cannot work fully without it. You can change permission in iOS Settings.
The current App processes precise location for nearby discovery and journey progress on the device. Shade On You does not require an account and does not send your precise location to a Shade On You-operated server. Operator arrival requests identify a route and stop, weather requests obtain public observations or forecasts, and Apple provides maps and location under its own terms and privacy practices. Signed data packs are delivered through Cloudflare.
Preferences, bookmarks, installed-pack records and support-purchase acknowledgements are stored on the device. Deleting the App removes its ordinary local application data subject to iOS and backup behaviour.
6. Language and discrepancies
The English version of these Terms is the authoritative version. Traditional Chinese and Simplified Chinese translations are provided for convenience. If there is any inconsistency or discrepancy between a translation and the English version, the English version prevails.
If information presented by Shade On You differs from the current information of a transport operator, public authority, data provider, or applicable third-party terms, that organisation's official information governs its own service, data, or terms. Please report a suspected Shade On You discrepancy through the support contact so it can be investigated.
7. Network access and downloads
Some features require Internet access, including live arrival information, weather information, maps, and installation or update of detailed data packs. Your carrier or service provider may charge for network use. Downloaded packs consume device storage and can be reviewed, updated, or deleted under Settings.
Offline availability depends on the catalogue and compatible packs already installed on the device. An installed pack can become incompatible or outdated after the App or source data changes.
7A. Optional developer support
You may choose a one-time consumable in-app purchase to support the developer. Support is entirely voluntary: it unlocks no features, content or services and creates no promise of future updates, products or services. Declining support does not change your access to the App. Support is not a subscription or a charitable donation; each repeat purchase requires a separate decision.
Apple presents the applicable localized price and handles payment. The App does not collect your payment-card details. Because no entitlement is supplied, consumable tips have no restorable feature. Refund requests can be made through Apple's refund service, subject to Apple's process and applicable law. Nothing here limits your mandatory consumer rights.
8. Acceptable use
You may use the App for lawful personal or organisational journey planning. You must respect applicable laws, these Terms, third-party service terms, and source data licences. You are responsible for any use of information exported, reproduced, or redistributed from the App.
9. Shade On You intellectual property
Except for identified third-party material and open-source components, the App, its interface, original code, branding, and Shade On You-generated presentation are owned by or licensed to the publisher. These Terms permit use of the App; they do not transfer ownership of Shade On You or third-party intellectual property.
10. Third-party services
Links and third-party services are provided for convenience and functionality. Their operators control their content, availability, terms, and privacy practices. Shade On You is not responsible for third-party services or for changes made by their operators.
11. Disclaimer and limitation of liability
To the maximum extent permitted by applicable law, the App is provided on an as-is and as-available basis without warranties of accuracy, availability, fitness for a particular purpose, or uninterrupted operation.
To the maximum extent permitted by applicable law, the publisher will not be liable for indirect, incidental, special, consequential, or similar loss arising from use of, inability to use, or reliance on the App or its data. Nothing in these Terms excludes or limits a right or liability that cannot lawfully be excluded or limited.
12. Changes and discontinuation
The publisher may change the App or these Terms to reflect product, legal, security, or data-source changes. Material revised Terms will be presented for acceptance before continued use where appropriate. Features or the App may be suspended or discontinued.
13. Governing law
These Terms are governed by the laws of the Hong Kong Special Administrative Region. The forum for disputes is the courts of Hong Kong, except where applicable law requires otherwise.
